In line with the “Smart Regulation” framework, which encompasses the entire policy-making cycle and enhances the consultation process with legislation’s end recipients, the Republic of Cyprus has introduced a draft bill to transpose Directive 2021/1883 into national law. This Directive, commonly referred to as the “Blue Card Directive,” establishes the conditions for the entry and residence of third-country nationals seeking highly skilled employment within the European Union.

The Directive and the accompanying Bill outline the criteria for third-country nationals to reside in Cyprus for periods exceeding three months. Additionally, the legislation facilitates mobility within member states by recognizing other member states as second member states for these purposes.

Key provisions of the Bill include:

  • Entry and Residence Conditions: Defines the requirements for third-country nationals to enter and reside in Cyprus for highly skilled employment for periods longer than three months.
  • Mobility Provisions: Allows third-country nationals to move between member states, recognizing other member states as second member states to promote workforce mobility.
  • Rights of Workers and Families: Establishes the rights of highly skilled third-country nationals and their family members, ensuring access to employment opportunities and associated benefits.

The Bill incorporates the mandatory provisions of the Directive directly into national law, ensuring compliance with EU requirements. Additionally, it includes optional provisions, granting Cyprus the flexibility to adapt certain aspects of the legislation to better suit national needs and circumstances.

Advantages of the EU Blue Card Over National Permits

  1. Mobility Within the EU:
    • Short-Term Mobility: The Blue Card allows its holder short-term mobility, meaning they can enter and stay in other EU Member States for up to 90 days within any 180-day period without additional formalities.
    • Long-Term Mobility: After 12 months of residence in Cyprus, a Blue Card holder and their family members can relocate to a second Member State for the purpose of highly skilled employment.
  2. Access to Long-Term Resident Status:
    • Under more favorable provisions of the Directive, a Blue Card holder can accumulate periods of residence in different Member States to meet the duration requirement for obtaining long-term resident status.
  3. Temporary Unemployment:
    • A Blue Card holder retains the permit during specific periods of unemployment, ensuring continued legal status.

The practical implementation of the Blue Card in the Republic of Cyprus has not yet been finalized. The Migration Department will issue an official announcement once the specific details are determined.
